What Are the Legal Grounds for Divorce in New Jersey?

There are many valid reasons to end a marriage in New Jersey, but judges only recognize a few specific ones. As grounds for divorce have changed through the years, most serious issues will fall under a legal category. However, spouses must provide evidence of the reason beyond a reasonable doubt, which is not always easy to accomplish.

Here are the grounds to divorce legally in New Jersey:

  • Willful desertion for more than a 12-month period
  • Adultery
  • Extreme mental or physical cruelty
  • Drug or alcohol addiction for a period exceeding one year
  • Voluntary or forced institutionalization for mental illness over a minimum of two consecutive years
  • Incarceration for at least 18 months
  • Deviant or grossly inappropriate sexual conduct
  • Irreconcilable differences
  • Complete separation, including different housing, for no less than 18 months
Do Courts Handle Divorces Differently According to Various Life Stages?

The longer the marriage, the more assets the couples accrue, which makes divorcing extremely complicated for senior citizens. If the union lasted 20 years or longer, lifetime alimony may still apply, which does not exist for younger divorcees anymore in New Jersey, after spousal support laws changed in 2014.
