There are several myths about divorce law in New Jersey. Once you know the facts, you may very well decide that there is no reason to live in an unhappy marriage. You may be worried about keeping your children, for example, or about how you will make ends meet financially after divorce.

  5. While the courts will consider the desires of the children, the children cannot choose who they want to live with, and the final decision will be based on what the court decides is in the children’s best interests.
  6. It is usually not easier and safer to handle a divorce without a lawyer.
What Are the Legal Grounds for Divorce in New Jersey?

There are many valid reasons to end a marriage in New Jersey, but judges only recognize a few specific ones. As grounds for divorce have changed through the years, most serious issues will fall under a legal category. However, spouses must provide evidence of the reason beyond a reasonable doubt, which is not always easy to accomplish.

Here are the grounds to divorce legally in New Jersey:

  • Willful desertion for more than a 12-month period
  • Adultery
  • Extreme mental or physical cruelty
  • Drug or alcohol addiction for a period exceeding one year
  • Voluntary or forced institutionalization for mental illness over a minimum of two consecutive years
  • Incarceration for at least 18 months
  • Deviant or grossly inappropriate sexual conduct
  • Irreconcilable differences
  • Complete separation, including different housing, for no less than 18 months
Do Courts Handle Divorces Differently According to Various Life Stages?

The longer the marriage, the more assets the couples accrue, which makes divorcing extremely complicated for senior citizens. If the union lasted 20 years or longer, lifetime alimony may still apply, which does not exist for younger divorcees anymore in New Jersey, after spousal support laws changed in 2014.

Older couples are also less likely to face child support and custody issues that involve young children. However, senior divorces are still complicated, and no two cases are identical.
